What Special Needs Parents Should Know About the 2026 ABLE Act Expansion

Starting on January 1, 2026, Congress expanded the Achieving a Better Life Experience (ABLE) Act to broaden who can open an ABLE account and help more people with disabilities save for their future. These changes were enacted as part of federal legislative updates and represent the most significant ABLE Act revision since the program began in 2014.



Core Features of ABLE Accounts


ABLE accounts are tax-advantaged savings vehicles designed for people with disabilities. ABLE account contributions are made with after-tax dollars, and they grow tax-free. In addition, qualified withdrawals used for disability-related expenses are not taxed. Importantly, funds in an ABLE account are treated differently from regular savings when determining eligibility for means-tested public benefits like Supplemental Security Income (SSI) and Medicaid. In many cases, up to $100,000 in ABLE balances does not count toward SSI’s resource limit.


Expanded Age-of-Onset Eligibility


Previously, to open an ABLE account, a person’s disability had to begin before age 26. Under the new rules, the age-of-onset requirement increases to before age 46. That means adults with later-onset disabilities, such as conditions from accidents, chronic illnesses, or mental health disorders diagnosed in adulthood, may now qualify. This change will open eligibility to millions more individuals with disabilities who have historically been excluded from ABLE planning.


Who Now Qualifies


To open an account under the 2026 ABLE account rules, the individual must:


• Have a qualifying disability that began before age 46 


• Have a disability that meets the Social Security Administration’s criteria for marked functional limitations expected to last at least 12 months


Income, employment status, and current benefit receipt are not prerequisites for ABLE eligibility. Parents and authorized representatives can open an account on behalf of an adult with a disability.


Planning Considerations for Families


Parents of special needs adults should consider several key points:


  • Documentation. Gather proof of disability onset. If a disability determination from Social Security was not made before age 46, a physician’s statement documenting the onset date may be needed to support eligibility.


  • Contribution limits and use. Annual contribution limits are adjusted periodically; for 2026, the limit is $20,000. Qualified disability expenses are broadly defined and include housing, education, assistive technology, transportation, and healthcare. Using ABLE funds appropriately and tracking spending is crucial to protect benefit eligibility.


  • Benefits planning integration. ABLE accounts are most effective when integrated into a broader benefits and financial strategy. Planning alongside special needs trusts and coordinating with benefits counselors and financial advisors can help families maximize resources without jeopardizing essential public supports.


Parents should begin reviewing eligibility now and set up an ABLE account early in the year to take full advantage of these expanded opportunities.
